Buyer: an individual or legal entity, as well as any other legal entity that registers an account to purchase products made available through the website managed by the Seller and gains access to the site’s content through any means of communication provided by GSMnet.de or based on an existing usage agreement between GSMnet.de and the buyer, concluded following the registration of an account on the domain belonging to GSMnet.de.
Account: The section of the Site consisting of an email address and its associated password, which allows the Buyer to place an Order and contains information about the Buyer and the Buyer's history on the Site.

The Seller assumes no responsibility for damages resulting from the use of the products after delivery, much less for their loss.

Special Offers / Promotions: an action through which, for commercial purposes, the Seller makes available a limited number of Goods and/or Services with a predefined stock, for limited periods of time, pre-established by the Seller.
Distance Contract: any contract concluded between the Seller and the Buyer within an organized distance sales or service-provision system, without the simultaneous physical presence of the professional and the consumer, using exclusively one or more means of distance communication up to and including the moment the contract is concluded.
The conclusion of the contract occurs at the time of issuing the tax invoice, not at the time of placing the order or issuing the automatic receipt confirmation of that order.

- all information on the Site that can be visited, viewed, or accessed using electronic equipment;
- the content of any email sent to Buyers by the Seller via electronic means and/or any other available communication method;
- data about the Seller or other data related to it;
- information related to the Goods and/or Services and/or rates usually practiced by the Seller in different periods;
- information related to the Goods and/or Services and/or rates practiced by a third party with which the Seller has partnership contracts, in different periods.
Price and Payment Methods: the amount of money paid by the Buyer in exchange for which the Seller transfers ownership of a good or provides a service for the Buyer’s benefit, communicated through the Site at the time of placing the order.
The prices of the Goods provided by the Seller are expressed in EURO and include VAT.
The Seller validates the order only if:
- The Buyer’s data is complete and correct;
- The products in the Buyer’s order are available;
- There are no system errors that could generate incorrect prices (e.g., zero value or negligible price).
This moment marks the conclusion of the Sale-Purchase Contract.
In accordance with the law, all product prices include the Green Stamp Tax. If the Buyer wishes to know the exact value of this tax or other related details, they may contact the Seller at the address: office[@]GSMnet.de.
The order form includes additional delivery costs. The price, payment method, and payment deadline are specified in each Order. The Seller will issue an invoice to the Buyer for the delivered Goods and Services, and the Buyer is obliged to provide all the necessary information for issuing the invoice in accordance with current tax legislation.
If the Buyer uses online payment methods, the Seller is not responsible for any additional costs added to the price of the Goods or Services ordered by the Buyer. In the case of cash-on-delivery payments, the Seller is not responsible for the Buyer’s delay in collecting the Goods from the courier, which may result in storage fees.
The Seller will send the Buyer the invoice related to the Order placed, covering the requested Goods and Services, as well as any other payments related to the Order, in electronic format to the email address used to place the order and by adding the invoice to the Personal Account on the site (for customers who have an account). At the Buyer’s request, the Seller will also provide the invoice in printed format along with the ordered Goods and Services.
The Buyer has the right to request the rectification of data in their Personal Account if it is incorrect, including the right to complete incomplete personal data (Art. 16 GDPR). By submitting the Order, the Buyer agrees that the Seller may issue the invoice based on the data available at the time of placing the order and send it in printed or electronic format to the delivery address or the email address specified in the Personal Account or when placing the order.
Delivery: The ordered products are delivered via the transport and payment method chosen by the Buyer at the time of placing the order. The products will be properly packaged, sealed, and insured throughout the transportation period until the moment of receipt by the Buyer.
Ownership of the Products will be transferred upon receipt, after payment is made by the Buyer at the location specified in the Order. Receipt is considered completed at the moment of signing the transport document provided by the courier or signing the receipt on the invoice in the case of deliveries made by the Seller’s personnel.

Rating: a method of expressing a Buyer’s level of satisfaction with a product. The satisfaction level can be expressed through the star rating system, with each product able to receive a score from one star (unsatisfactory level) to five stars (maximum satisfaction threshold). Rating is not mandatory and does not affect the sale-purchase contract between the two parties in any way.
Comment: an observation or critique recorded by the Buyer in the comments section related to each product. The comment sometimes accompanies the rating and is optional. Regardless of the type of comment, it does not affect the sale-purchase contract between the two parties in any way and serves only as informative content for future customers interested in the same product.
Newsletter: a periodic method of communicating information by the Seller via email regarding Goods, Promotions, Contests, and/or Services offered by the Seller. Subscribing to the newsletter is not mandatory. It is done with your consent by completing the newsletter subscription forms on the site. You can unsubscribe at any time by accessing the “Unsubscribe” link present in each Newsletter or by accessing your Personal Account, in the Account Settings section.
If you decide not to provide us with personal data for subscribing to the Newsletter, this will not have any consequences for you, as this data is not a legal, contractual, or necessary requirement to conclude a contract. Green Stamp Tax: an amount of money paid by producers to cover the costs of collection, reuse, and recycling of electronic equipment.
Specifications: a section listing and explaining the technical, physical, and software characteristics of the Goods on the site.
Right of Withdrawal: The right of an individual Buyer to benefit from a 14-day period to withdraw from a distance contract without having to justify the withdrawal decision and without incurring costs other than those provided by law. If the individual Buyer exercises their right of withdrawal, they will complete the standard form found in the Return and Refund Policy section of the customer account that placed the order on the site.
The Seller will refund all amounts received as payment from the Buyer, including delivery costs where applicable, without undue delay and, in any case, no later than 14 days from the date the Seller is informed of the consumer’s decision to withdraw from the contract in accordance with Art. 11, provided the products are returned in the same condition in which they were delivered to the Buyer.
The Buyer will bear the cost related to returning the products in case of withdrawal. Thus, the Buyer bears only the direct costs related to returning the products and is responsible for any reduction in the value of the products resulting from handling them.
Conformity: All Products marketed by GSMnet.de comply with applicable laws and meet the norms and standards under which they were created.
Confidentiality: Mobiparts SRL, the owner of the GSMnet.de brand, is the controller of the personal data you provide to us and is responsible for your personal data in accordance with applicable data protection legislation.
SC Mobiparts SRL is registered in the personal data processing record of the National Supervisory Authority for Personal Data Processing under no. 10803.
SC Mobiparts SRL undertakes to use customer data exclusively for the purpose for which it was provided (placing online orders and commercial information about products sold in our online store). We undertake not to transmit personal data to third parties and to respect data confidentiality. SC Mobiparts SRL does not encourage SPAM, does not trade email addresses obtained through this site, does not disclose your email address to other individuals, and does not provide your address/phone number or other data to third parties.

EXERCISING THE RIGHT OF WITHDRAWAL
Right of Withdrawal
You have the right to withdraw from this sale-purchase contract, without stating reasons, within 14 days.
The withdrawal period expires 14 days from the date of contract conclusion or from the date you or a third party, other than the carrier, indicated by you, takes physical possession of the products (in the case of a contract for multiple goods ordered by the Buyer in a single order, from the date you or a third party, other than the carrier, indicated by you, takes physical possession of the last product).
To exercise your right of withdrawal, you must inform us by completing and submitting the standard withdrawal form electronically on our website www.GSMnet.de in the Returns and Warranties section of your Personal Account. We will send you a confirmation of receipt of the withdrawal request via email without delay.
To meet the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw, we will refund all amounts we have received from you, including delivery costs, except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us, without undue delay and, in any case, no later than 14 days from the date we are informed of your decision to withdraw from this contract. We will carry out this refund using the same payment method as the one used for the initial transaction, unless you have expressly agreed to another refund method; in any case, no fees will be charged to you as a result of such a refund. We may defer the refund until the date we receive the products back or until you provide proof that you have sent the products back, whichever is earlier.
ATTENTION! Upon return, we do not accept cash-on-delivery packages. The order amount will be refunded within a maximum of 14 calendar days from the written notification that you are withdrawing from the purchase of the product, provided the products are returned in the same condition in which they were delivered to the Seller. Written notification is made through the Return form available in the “Returns/Warranties” section of the account used to purchase the product.
The consumer is responsible only for the reduction in the value of the products resulting from handling other than that necessary to determine the nature, qualities, and functioning of the products. If the product is returned in a condition in which it can no longer be sold as new, we reserve the right to request a fee to restore it to its original condition (if possible). If the customer does not agree to this fee, the product will be returned to them at their expense. This clause applies in accordance with Emergency Ordinance No. 34/2014, in the case of purchasing products from this site using distance communication techniques, applying the definitions contained in Emergency Ordinance No. 34/2014.
General Return and Warranty Conditions Applicable to All Products
We note that, in accordance with Emergency Ordinance No. 34/2014, the consumer will bear the costs related to the return. The transportation cost is borne by the consumer and must be paid directly to the courier. As a transport service, the consumer may choose any courier company except the Romanian Post. If the customer wishes, they may use our delivery service, in which case the amount of 20 Lei will be deducted from the value of the returned product, according to our contract with the courier company.
Transportation costs are borne by our company only in the case of products defective from manufacturing or damaged during transport.
You can return products within 14 working days from the moment they were delivered to you by the courier, whether you are an individual or a legal entity. Therefore, to be considered, the return form may be sent no later than the 14th working day from the date of delivery/pickup (from the showroom) of the product.
You can return any product you receive with a manufacturing defect within 14 working days from the delivery date.
All products you return must be in the same condition in which you received them. We cannot accept products that have undergone unauthorized interventions or have been damaged by you: signs of wear or excessive use, scratches, chips, dents, mechanical/electrical shocks; likewise, we cannot accept products that are not accompanied by all accessories.
If the products we delivered were accompanied by any gifts, when returning the products, you must also return the gifts.
If you purchased multiple products of the same type and wish to return them all, only one of the products may be unsealed; we can only accept the remaining products if they are sealed.
Products in the categories of Protective Films and Parts and Components that have not been installed in a GSM service center are exempt from the Right of Withdrawal and Warranty. We note that these must be tested/installed in a GSM service center by qualified personnel. They will issue a service receipt or certificate of finding (with a stamp) attesting to the operation performed. Otherwise, the products do not benefit from a warranty, as their installation requires technical knowledge.

Ownership of the Products will be transferred upon receipt, after payment is made by the Buyer at the location specified in the Order. Receipt is considered completed at the moment of signing the transport document provided by the courier or signing the receipt on the invoice in the case of deliveries made by the Seller’s personnel.

Rating: a method of expressing a Buyer’s level of satisfaction with a product. The satisfaction level can be expressed through the star rating system, with each product able to receive a score from one star (unsatisfactory level) to five stars (maximum satisfaction threshold). Rating is not mandatory and does not affect the sale-purchase contract between the two parties in any way.
Comment: an observation or critique recorded by the Buyer in the comments section related to each product. The comment sometimes accompanies the rating and is optional. Regardless of the type of comment, it does not affect the sale-purchase contract between the two parties in any way and serves only as informative content for future customers interested in the same product.
Newsletter: a periodic method of communicating information by the Seller via email regarding Goods, Promotions, Contests, and/or Services offered by the Seller. Subscribing to the newsletter is not mandatory. It is done with your consent by completing the newsletter subscription forms on the site. EXERCISING THE RIGHT OF WITHDRAWAL
Right of Withdrawal
You have the right to withdraw from this sale-purchase contract, without stating reasons, within 14 days.
The withdrawal period expires 14 days from the date of contract conclusion or from the date you or a third party, other than the carrier, indicated by you, takes physical possession of the products (in the case of a contract for multiple goods ordered by the Buyer in a single order, from the date you or a third party, other than the carrier, indicated by you, takes physical possession of the last product).
To exercise your right of withdrawal, you must inform us by completing and submitting the standard withdrawal form electronically on our website www.GSMnet.de in the Returns and Warranties section of your Personal Account. We will send you a confirmation of receipt of the withdrawal request via email without delay.
To meet the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of Withdrawal
If you withdraw, we will refund all amounts we have received from you, including delivery costs, except for additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us, without undue delay and, in any case, no later than 14 days from the date we are informed of your decision to withdraw from this contract. We will carry out this refund using the same payment method as the one used for the initial transaction, unless you have expressly agreed to another refund method; in any case, no fees will be charged to you as a result of such a refund. We may defer the refund until the date we receive the products back or until you provide proof that you have sent the products back, whichever is earlier.
ATTENTION! Upon return, we do not accept cash-on-delivery packages. The order amount will be refunded within a maximum of 14 calendar days from the written notification that you are withdrawing from the purchase of the product, provided the products are returned in the same condition in which they were delivered to the Seller. Written notification is made through the Return form available in the “Returns/Warranties” section of the account used to purchase the product.
The consumer is responsible only for the reduction in the value of the products resulting from handling other than that necessary to determine the nature, qualities, and functioning of the products. If the product is returned in a condition in which it can no longer be sold as new, we reserve the right to request a fee to restore it to its original condition (if possible). If the customer does not agree to this fee, the product will be returned to them at their expense. This clause applies in accordance with Emergency Ordinance No. 34/2014, in the case of purchasing products from this site using distance communication techniques, applying the definitions contained in Emergency Ordinance No. 34/2014.
General Return and Warranty Conditions Applicable to All Products
We note that, in accordance with Emergency Ordinance No. 34/2014, the consumer will bear the costs related to the return. The transportation cost is borne by the consumer and must be paid directly to the courier. As a transport service, the consumer may choose any courier company except the Romanian Post. If the customer wishes, they may use our delivery service, in which case the amount of 20 Lei will be deducted from the value of the returned product, according to our contract with the courier company.
Transportation costs are borne by our company only in the case of products defective from manufacturing or damaged during transport.
You can return products within 14 working days from the moment they were delivered to you by the courier, whether you are an individual or a legal entity. Therefore, to be considered, the return form may be sent no later than the 14th working day from the date of delivery/pickup (from the showroom) of the product.
You can return any product you receive with a manufacturing defect within 14 working days from the delivery date.
All products you return must be in the same condition in which you received them. We cannot accept products that have undergone unauthorized interventions or have been damaged by you: signs of wear or excessive use, scratches, chips, dents, mechanical/electrical shocks; likewise, we cannot accept products that are not accompanied by all accessories.
If the products we delivered were accompanied by any gifts, when returning the products, you must also return the gifts.
If you purchased multiple products of the same type and wish to return them all, only one of the products may be unsealed; we can only accept the remaining products if they are sealed.
Products in the categories of Protective Films and Parts and Components that have not been installed in a GSM service center are exempt from the Right of Withdrawal and Warranty. We note that these must be tested/installed in a GSM service center by qualified personnel. They will issue a service receipt or certificate of finding (with a stamp) attesting to the operation performed. Otherwise, the products do not benefit from a warranty, as their installation requires technical knowledge.
